Acceptance of Terms

By accessing and using the services provided by drylannzca B.V. (registration number 52749831), including our website at drylannzca.live and our property brokerage services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and drylannzca B.V., a company incorporated under Dutch law with its registered office at Kastanjelaan 100, 2510 GV The Hague, Netherlands.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new terms.

drylannzca provides professional property brokerage services in The Hague and South Holland region, including but not limited to:

  • Transaction coordination and support

All services are provided in accordance with Dutch real estate law and regulations governing property brokerage activities.

User Obligations and Responsibilities

When using drylannzca services, you agree to:

  • Provide accurate, complete, and up-to-date information
  • Act in good faith in all transactions and communications
  • Comply with all applicable laws and regulations
  • Respect the intellectual property rights of drylannzca and third parties
  • Not use our services for any unlawful or fraudulent purposes

  • Pay all agreed fees and charges in a timely manner

Fees and Payment Terms

Service fees will be clearly communicated and agreed upon before commencement of services. Payment terms include:

  • Payment is due according to the terms specified in individual service agreements
  • Late payment may incur additional charges as permitted by law
  • All fees are exclusive of VAT unless otherwise stated
  • Refund policies will be specified in individual service agreements

Intellectual Property Rights

All content, materials, and intellectual property related to drylannzca services, including but not limited to website content, marketing materials, property descriptions, photographs, logos, and trademarks, are owned by drylannzca B.V. or licensed to us by third parties.

You may not:

  • Reproduce, distribute, or publicly display our copyrighted materials without permission
  • Use our trademarks or logos without written consent
  • Create derivative works based on our intellectual property
  • Use our content for commercial purposes without authorization

Nothing in these terms excludes or limits liability for:

Clients are advised to obtain independent legal and financial advice for property transactions.

Professional Standards and Disclaimers

drylannzca operates under professional standards and regulatory requirements. However:

  • Property transactions involve inherent risks and uncertainties
  • Market conditions can change rapidly and unpredictably
  • Legal and regulatory requirements may change
  • Property information is subject to verification and may contain errors
  • Professional advice should be sought for legal and financial matters
  • We cannot guarantee specific outcomes or timelines

Clients are responsible for making their own informed decisions based on available information and professional advice.

Termination of Services

Either party may terminate the service relationship under the following circumstances:

  • By mutual agreement at any time
  • By either party with reasonable notice as specified in service agreements
  • Immediately for material breach of these terms
  • If continuation of services becomes impractical or impossible
  • For non-payment of fees after proper notice

Upon termination:

  • All outstanding fees become immediately due
  • Confidentiality obligations continue
  • Both parties must return confidential materials
  • Ongoing transactions may be completed or transferred as agreed

Termination does not affect accrued rights and obligations or clauses intended to survive termination.

Dispute Resolution

We encourage resolution of disputes through direct communication. If disputes cannot be resolved informally:

  • Mediation may be pursued through a mutually agreed mediator
  • Complaints may be made to relevant professional bodies
  • Legal proceedings must be commenced within applicable limitation periods
  • Alternative dispute resolution methods may be considered

We are committed to fair and professional resolution of any issues that may arise.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts.

  • Dutch courts have exclusive jurisdiction for legal proceedings

Nothing in these terms affects your statutory rights as a consumer under applicable law.

Force Majeure

drylannzca shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or public health emergencies
  • Government actions, laws, or regulations
  • Wars, terrorism, or civil unrest
  • Technical failures or cyber attacks
  • Labour disputes or strikes
  • Supplier or third-party failures

In such circumstances, we will make reasonable efforts to minimize disruption and resume normal service as soon as possible.

Severability and Entire Agreement

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. These Terms of Service, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and drylannzca B.V.

These terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.
